Kinville trial to begin Sept. 28

Michael Kinville, 23, was arrested on charges of assault by strangulation and domestic violence on May 30. 

Former Central Michigan University football player Michael Kinville faces assault by strangulation and domestic violence charges after police say he choked his girlfriend May 30 inside an apartment at Deerfield Village.

Kinville was bound over to circuit court. His trial will take place Sept. 28. 

At the Aug. 13 preliminary examination, Holland senior Joslyn Seger testified against Kinville, saying she drove to Mount Pleasant from her hometown the night of his arrest because the couple had been fighting earlier in the night. Seger said the argument "felt different" than previous ones and she wanted to talk to Kinville in person.

Kinville arrived via taxi with his ex-girlfriend to a friend's apartment where he was staying. Seger was waiting when he arrived, and said she slapped Kinville's face and knocked a beer bottle out of his hand. She told the ex-girlfriend to get back in the taxi and leave.

Chippewa Cab driver Bruce Hoyt testified that Seger ran up to Kinville and slapped him, knocking his head back. Hoyt said Kinville seemed calm, and referred to Seger as a "violent aggressor" and said she was "out of control." 

After the other woman left, Seger said she and Kinville went inside the apartment, where he laid down on a bed. She said she questioned why Kinville was with his ex, and that he ignored her questions. Kinville grabbed her foot and Seger said she fell to the floor.

"He got on top of me and put his hand over my mouth and told me to stop screaming," Seger said. 

After Kinville, who is 6'3, let her up, Seger, who is 5'1, said she went to the hallway of the apartment. Kinville followed her then lifted Seger off the ground by her throat. He then moved her onto the floor, never letting go of her neck. Seger said he choked her for a few more seconds while straddling her, let go and sat up next to her on the floor. 

After the incident, Seger went into a different bedroom and called her friend. Seger said she assumed Kinville had gone to sleep and went upstairs to call her father. Her last call was to the police. 

Isabella County Deputy Thomas Szidik arrived and interviewed both Kinville and Seger. Kinville denied being slapped and assaulting Seger. The officer testified that Kinville was highly intoxicated and uncooperative when he was being interviewed. 

"I had probable cause to arrest Michael Kinville," he said. 

Seger reported pain in her ribs following the assault. She had visible bruising on the left side of her throat and a red mark on her right hand, according to court documents.
