Judge dismisses Elliott defense's attempt to dismiss charges

Isabella County Trial Court Judge Eric Janes dismissed former Student Government Association President Ian Elliott’s defense’s attempt to dismiss Elliott’s charges at a hearing April 8, according to court records. 

Elliott’s defense attorney Joe Barberi filed a motion alleging prosecutor misconduct and asking the court to dismiss charges March 6. 

The motion accused Assistant Attorney General Brian Kolodziej of withholding information from the court and violating ethical rules as a prosecutor.

Elliott is charged with two counts of third degree criminal sexual assault and one count of assault with intent to commit sexual penetration. He allegedly sexually assaulted Rachel Wilson after meeting her at The Cabin in 2016. 

Separate charges were filed by Landrea Blackmore after she testified in the first case at a preliminary exam. In that case, Elliott is charged with third degree criminal sexual conduct. 

The trial is scheduled for July 8.
