Firework use after 12:59 a.m. Wednesday a violation of Mount Pleasant ordinance

Shooting off fireworks in Mount Pleasant is illegal after 12:59 a.m. Wednesday.

According to the city's ordinance, a person "may ignite, discharge or use consumer fireworks within the city on the day proceeding, the day of or the day after a holiday, but not between the hours of 1:00 a.m. and 8:00 a.m." It is a violation to use fireworks at any other time.

State law limits the regulations cities can enact regarding fireworks.

"This (ordinance) is to balance the safety and enjoyment of the public," said City Manager Nancy Ridley. "Not all members of the public enjoy the noise created by the fireworks."

The ordinance goes on to state that if a city police officer determines a violation has occurred, the officer may issue a municipal civil infraction citation. Punishment is not to exceed $500 and officers may seize the consumer fireworks, "articles pyrotechnic, display fireworks or low-impact fireworks" as evidence of the violation. A person found in violation of the ordinance is required to reimburse the city for the costs of storing, disposing of or destroying the fireworks confiscated.
